* All items sold "AS IS, WHERE IS" descriptions believed accurate but not guaranteed.
* By placing a bid, bidder signifies that they are bidding regardless of item condition.
* 12% Buyer's premium rate charged to all winning bids of personal property.
* SALES TAX will NOT be charged FOR THIS AUCTION (except for titled vehicles)
* 3% user fee will be charged for Visa/MC/Discover/AE credit card transactions.
* We reserve the right to cancel and/or reopen the auction bidding.
* ITEMS NOT PICKED UP are FORFEITED & NO REFUNDS WILL BE ISSUED.
* Graber Auctions may reserve the right to reject any bid at it's sole discretion.
PICK UP FOR THE MISC ITEMS IS SCHEDULED FOR Thursday, January 5, 2023 from 10:00am to 5:00pm ET BY APPOINTMENT ONLY - a calendar will be emailed to winning bidders.
GUNS will be transferred by Randy at Greenwell Hardware. There will be a $20.00 transaction fee at pick up for Indiana Residents. (Out of State buyers will have an additional shipping fee to ship the gun to nearest FFL dealer in your State).
**You must arrange pickup for guns with Randy at Greenwell Hardware, the scheduled pickup time does NOT reflect the pickup time for guns. PLEASE CALL RANDY AT (812) 295-3597 TO ARRANGE PICKUP IF YOU PURCHASED A GUN.
Shipping is available for small items only, with United Packing and Shipping, (812) 886-9499.
(Hazardous items cannot be shipped such as liquids, perfumes, ammo, chemicals, radioactive materials, compressed gases, dry ice, liquid nitrogen, lithium batteries and more).
Deposit: In order for the Auctioneer to process your winning bid, we must have a working Visa, MasterCard or Discover associated with your account.
Photographs and Descriptions: The Auctioneer regularly posts item descriptions and photographs to aid bidders in the bidding process, and we make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. In some photographs, multiple items may appear to be joined as a single unit, however you should not assume that a lot consists of more than one item simply because various items appear connected or are featured in the same photograph. Also understand that, on occasion, the wrong photograph may be displayed for a given item. At all times, you are bidding on items as they are described on this website, not as they appear in any photograph.
ALL LOTS AND ITEMS ARE SOLD AS IS, WHERE IS, WITH NO EXPRESS OR IMPLIED WARRANTIES. IT IS BELIEVED THAT ALL DESCRIPTIONS ARE ACCURATE BUT NOT GUARANTEED.
When You Have Been Outbid: If you are outbid during the course of this auction, you will be notified by email. You can review your bids at any time using the Auctioneer’s “Review Bids” feature; items on which you have been outbid will be clearly marked.
Changes in Circumstance: All aspects of this auction are subject to change without notice. The Auctioneer reserves the right to, at any time, add or remove items from the auction.
Winning Bids: If you place a bid in this sale, and your bid is determined to be the winning bid, you become obligated to pay for the item that you have won at the price you gave as your bid.
Payment: At the conclusion of this auction, the credit card associated with your account will be automatically charged for the full price of your purchases.
REAL ESTATE TERMS:
NOTE: Owner has the right to reject final bid on Real Estate. The high bidder will receive confirmation of acceptance or rejection of the final bid by 12pm on Wednesday, January 4, 2023.
DOWN PAYMENT: $2,000 down payment along with the 2% Buyers Premium. The down payment will be required upon acceptance of bid & applied to the purchase price. The down payment may be made in the form of check or cash and will be applied to purchase price.
YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing if needed. The Balance will be due at closing.
ACCEPTANCE OF BID PRICES: The successful bidder will be required to sign a Purchase Agreement upon acceptance of final bid. (The final bid is subject to the Sellers acceptance or rejection.)
EVIDENCE OF TITLE: Seller will provide a clear, marketable title to the purchaser. Seller shall provide an Owners Title Insurance policy in the amount of the purchase price.
DEED: Seller shall provide Warranty Deed(s).
CLOSING: The balance of the purchase price is due at closing, which will take place in 45+/- days after the auction, or as soon thereafter as applicable closing documents are completed by the Seller. Costs for an administered closing shall be shared 50/50 between Buyer(s) and Seller(s).
POSSESSION: Possession will be given at closing.
REAL ESTATE TAXES: Real Estate taxes shall be prorated to the date of closing.
PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property.
SURVEY: The cost of the survey, if needed, will be the responsibility of the buyer.
DISCLAIMER AND ABSENCE OF WARRANTIES: The property is being sold on an AS-IS, WHERE-IS basis, and no warranty expressed or implied, concerning the property is made by the Seller or the Auction Company. All sketches in the brochure are approximate. Each potential bidder is responsible for conducting his or her own independent inspections, investigations, and inquiries concerning the property. Conduct of the auction and increments of bidding are at the direction of the Auctioneer. The Seller and Selling Agents reserve the right to preclude any person from bidding if there is any question as to the person's credentials, fitness, etc. All decisions of the Auctioneer are final.
